Mobigosim Terms & Conditions
1. Introduction
These Terms and Conditions (the “Agreement”) govern the provision and use of Mobigosim’s eSIM services (“Service”). By purchasing or using the Service, the User agrees to be bound by this Agreement.
2. Definitions
2.1 “User” refers to any individual or entity using the Service.
2.2 “Data Plan” refers to the prepaid mobile data package offered by Mobigosim through its eSIM.
2.3 “Application” means the Mobigosim platform or related software through which the Service is accessed.
3. Scope of Service
3.1 Mobigosim provides Users with prepaid eSIM-based mobile data services in supported territories.
3.2 The Service does not include voice or SMS functionality unless expressly stated.
4. Conditions of Use
4.1 The Service is provided for lawful, personal use only.
4.2 Users shall not misuse the Service for any illegal or fraudulent activity.
4.3 Mobigosim reserves the right to suspend or terminate the Service in cases of misuse.
5. Orders and Activation
5.1 A Service order is complete when Mobigosim confirms acceptance and provides activation instructions.
5.2 Users are responsible for ensuring device compatibility with the eSIM.
6. Charges and Payments
6.1 Charges for Data Plans are payable in advance.
6.2 Payments are non-refundable except as expressly stated in this Agreement.
7. Duration and Termination
7.1 The Agreement remains in effect for the duration of the User’s selected Data Plan.
7.2 Mobigosim may suspend or terminate the Service if the User breaches these Terms.
8. User Obligations
8.1 Users must:
- (a) provide accurate registration details;
- (b) safeguard their device and eSIM credentials;
- (c) comply with applicable laws when using the Service.
9. Service Availability
9.1 While Mobigosim endeavors to provide continuous service, availability may depend on third-party network operators.
9.2 Mobigosim shall not be liable for interruptions caused by circumstances beyond its reasonable control.
10. Refund Policy
Payment for the Service is non-refundable. If Mobigosim is unable to provide the Service due to its fault, Customer has the right to request credit for future Service subject to the following refund policies:
- (a) eSIM purchased directly via the Application;
- (b) eSIM is not activated;
- (c) Purchase made within 7 days of refund request;
- (d) Refunds will not be granted if the incompatibility results from the User’s device not supporting eSIM technology.
11. Intellectual Property Rights
11.1 The eSIM, Application, and all related content (including software, databases, designs, graphics, and trademarks) are the proprietary property of Mobigosim or its licensors, protected under intellectual property laws.
11.2 Except as expressly permitted, no content or marks may be copied, distributed, reproduced, or exploited for commercial purposes without Mobigosim’s prior written consent.
12. Data Protection
12.1 By purchasing and using the Service, the User acknowledges that Mobigosim processes personal data in accordance with applicable data protection laws.

13. Indemnity
13.1 The User agrees to indemnify and hold harmless Mobigosim, its affiliates, employees, and service providers from any claims, damages, losses, or expenses arising from:
- (a) the User’s breach of this Agreement; or
- (b) misuse of the Service contrary to these terms.
14. Limitation of Liability
14.1 To the maximum extent permitted by law, Mobigosim shall not be liable for any indirect, incidental, or consequential loss arising from the Service.
14.2 Mobigosim’s total liability shall not exceed the greater of (i) the fees paid by the User under the relevant Data Plan during the preceding 12 months, or (ii) €100, except where liability cannot be lawfully excluded.
15. Governing Law and Jurisdiction
15.1 This Agreement and any disputes shall be governed by the laws of UAE, subject to mandatory applicable laws.
15.2 The courts of UAE shall have exclusive jurisdiction over disputes, unless otherwise required by law.
16. Variation of Terms
16.1 Mobigosim may amend these Terms by publishing updated terms on its Application with prior notice to Users, except where changes are beneficial, administrative, or required by law.
16.2 Continued use of the Service after such changes constitutes acceptance of the updated Terms.
17. General Provisions
17.1 Mobigosim may assign or transfer its rights and obligations under this Agreement without requiring User consent.
17.2 If any provision is found unenforceable, it shall be modified to the extent necessary to remain valid.
17.3 No failure to enforce rights shall constitute a waiver.
17.4 This Agreement is drafted in English. In case of conflict between translations, the English version shall prevail.
